In Spain, anyone can call themselves a property agent with no licence, no registration and no professional insurance. Before signing anything or paying any money to any agent, ask for their RAICV number (Registro de Agentes Inmobiliarios de la Comunitat Valenciana). Without it, there is no professional indemnity cover, no code of conduct and no body to complain to if something goes wrong.
The base price shown excludes all taxes and purchase costs. For new-build purchases in the Valencian Community, the buyer is responsible for: VAT (IVA) at 10 % of the purchase price; Stamp Duty (AJD) at 1.4 % on the purchase deed; notary fees (regulated tariff, approx. €750–1,500); land registry fees (approx. €450–700); and independent legal representation (approx. 1 % of price, minimum €1,500). If financing is used, the mortgage deed also carries its own AJD, but by law the lender pays it, not the buyer. Total additional costs are typically estimated at 12–13 % on top of the base price. Spanish law requires the developer to guarantee the property for three separate periods: 1 year for finishing defects (joinery, coatings, minor installations); 3 years for habitability defects (damp, insulation, plumbing); and 10 years for serious structural defects (foundations, load-bearing structure). For structural defects, the developer is legally required to hold a ten-year structural defect insurance policy (seguro decenal) before transferring the property. This insurance protects you even if the developer ceases to exist or becomes insolvent. Always request a copy of the seguro decenal policy before signing the purchase deed.
Spanish law requires developers to secure all payments made before completion with a bank guarantee (aval bancario) or insurance policy. This means that if the developer fails to complete the build or enters insolvency, you can recover any amounts paid. However, this protection only applies if the guarantee has actually been issued and is valid. Before making any advance payment, ask the developer for the corresponding bank guarantee documentation. Delivery of the property is conditional upon the developer obtaining the Licencia de Primera Ocupación — a mandatory municipal permit without which the property cannot be legally occupied, registered at the Land Registry or transferred by notarial deed.
