Why new build is objectively better

The comparison between new build and resale isn’t just a matter of taste. The numbers, the guarantees and the real 10-year cost speak for themselves.

New build isn’t more expensive. Work out the total cost over 10 years and it comes out ahead.

Your guarantees as a buyer of new build

These guarantees aren’t optional. The developer cannot remove or reduce them. They’re yours by law from the moment you sign the contract.

Your money has full legal cover

The LOE (Spanish Building Code) and Law 57/1968 require the developer to guarantee every euro paid, backed by a bank guarantee or surety insurance. If the development doesn’t go ahead, you get back 100% of your investment plus legal interest. It’s not a promise from the developer — it’s an obligation enforceable in court.

Decennial warranty — structural defects

Foundations, structure, roof. Defects affecting the building’s soundness are covered for 10 years from delivery.

3 years

Three-year warranty — habitability

Defects that compromise normal use: waterproofing, water installations, heating, ventilation.

1 year

One-year warranty — finishes

Coverings, flooring, carpentry, paintwork. Everything visible and tangible at the time of delivery.

Mandatory bank guarantee

Every payment made during construction is covered. A legal obligation the developer cannot avoid.

Full land registry filing

Notarised public deed and registration with the Land Registry. The highest level of legal protection in Spain.

  • Right to review the specifications document before signing
  • Inspection visit before the deed — you can flag defects
  • Maximum delivery deadline set in the contract, with penalties for the developer
  • Subrogation to the developer’s mortgage, or arranging your own

Budgeting properly from the start is the difference between a calm purchase and a stressful one. Here are the real costs for a resident in the Comunidad Valenciana.

On the purchase price. New build is taxed via VAT, not transfer tax.

Actos Jurídicos Documentados. Comunidad Valenciana. On the price registered in the deed.

Public deed, land registry filing and processing. Varies with the purchase price.

Set aside this extra percentage on top of the purchase price and you’ll reach signing day with total peace of mind. No last-minute surprises.

Mortgages for residents

Financing of up to 80% of the valuation for a primary residence. We compare offers from several lenders, with no bank tie-in. Arrangement fee of 1.5% (minimum €3,000); included if you buy through our buyer’s agent.

Subrogating the developer’s mortgage

Many developments already have a pre-arranged mortgage. It can save on arrangement fees. We’ll help you work out if it suits you.
